M\u00eame si parfois une personne choisit d\u2019occuper un emploi qui demande moins de comp\u00e9tences, en g\u00e9n\u00e9ral, pour la plupart des gens qui occupent des emplois pour lesquels ils sont surqualifi\u00e9s, il s\u2019agit plut\u00f4t de leur unique possibilit\u00e9 d\u2019emploi.<\/p>\n<p>Ce constat est particuli\u00e8rement vrai pour les nouveaux immigrants au Canada.<\/p>\n<p><img decoding=\"async\" style=\"margin: 10px;\" alt=\"\" src=\"http:\/\/www.hireimmigrantsottawa.ca\/wp-content\/uploads\/2013\/10\/law_000.jpg\" width=\"250\" height=\"146\" align=\"left\" hspace=\"10\" vspace=\"10\" \/>Les recruteurs \u00e9cartent g\u00e9n\u00e9ralement d\u2019embl\u00e9e les candidats surqualifi\u00e9s parce qu\u2019ils croient qu\u2019ils seront insatisfaits dans leur emploi et qu\u2019ils quitteront leur emploi apr\u00e8s une courte p\u00e9riode de temps. Or, deux r\u00e9centes \u00e9tudes internationales ont montr\u00e9 que cette perception est fauss\u00e9e. Par ailleurs, les employeurs au Canada doivent d\u00e9sormais prendre en compte la loi en ce qui concerne un segment de la population surqualifi\u00e9e, \u00e0 savoir les immigrants membres de minorit\u00e9s visibles.<\/p>\n<p>En 2006, le Tribunal canadien des droits de la personne a rendu un jugement historique sur la surqualification comme raison justifiant l\u2019\u00e9limination de candidats immigrants appartenant aux minorit\u00e9s visibles. Statistique Canada d\u00e9finit un r\u00e9cent immigrant comme une personne qui est r\u00e9sidente permanente depuis 5 \u00e0 10 ans et un immigrant tr\u00e8s r\u00e9cent comme une personne qui est au Canada depuis moins de cinq ans. L\u2019affaire concernait une plainte d\u00e9pos\u00e9e aupr\u00e8s de la Commission canadienne des droits de l\u2019homme par M. Gian Sangha apr\u00e8s que sa candidature a \u00e9t\u00e9 rejet\u00e9e pour le poste d\u2019agent de la r\u00e9glementation (AR) aupr\u00e8s du Mackenzie Valley Land and Water Board (office des terres et des eaux de la Vall\u00e9e du Mackenzie).<\/p>\n<p>L\u2019offre d\u2019emploi que l\u2019Office a plac\u00e9e dans le journal concernant quatre postes d\u2019AR pr\u00e9cisait les exigences requises : dipl\u00f4me dans un domaine pertinent et deux ann\u00e9es d\u2019exp\u00e9rience dans un domaine connexe; ou dipl\u00f4me d\u2019\u00e9tudes postsecondaires en gestion de l\u2019environnement et trois ann\u00e9es d\u2019exp\u00e9rience; connaissances de la technologie de ce domaine et des enjeux connexes; connaissance fonctionnelle de logiciels; capacit\u00e9 de r\u00e9diger des rapports techniques; permis de conduire. Les postes d\u2019AR avaient un mandat de trois ans, sous r\u00e9serve d\u2019une p\u00e9riode probatoire de six mois, avec une possibilit\u00e9 de prorogation de deux ans.<\/p>\n<p>L\u2019AR assume des fonctions administratives normalis\u00e9es telles que le traitement de demandes de permis d\u2019utilisation des terres et de permis d\u2019utilisation des eaux. Il doit en outre collaborer avec des examinateurs aux fins d\u2019examen et pr\u00e9parer des rapports pour le Conseil. Bien que les AR doivent avoir des connaissances techniques de base, une expertise technique peut \u00eatre obtenue \u00e0 l\u2019interne ou aupr\u00e8s de consultants externes. L\u2019Office jugeait aussi important que les AR poss\u00e8dent une certaine connaissance en mati\u00e8re de questions environnementales dans le Nord du Canada, qu\u2019ils aient v\u00e9cu dans les r\u00e9gions nordiques et qu\u2019ils poss\u00e8dent une certaine connaissance des collectivit\u00e9s des Premi\u00e8res Nations.<\/p>\n<p>Le comit\u00e9 d\u2019entrevue de l\u2019Office (form\u00e9 d\u2019une directrice des finances et de l\u2019administration, d\u2019un gestionnaire hi\u00e9rarchique et d\u2019un employ\u00e9 du domaine technique) a interview\u00e9 12 postulants parmi les 38 demandes re\u00e7ues (deux poss\u00e9daient un dipl\u00f4me coll\u00e9gial, neuf poss\u00e9daient un baccalaur\u00e9at, et M. Sangha). Le comit\u00e9 a \u00e9limin\u00e9 tous les postulants qui n\u2019avaient qu\u2019un dipl\u00f4me d\u2019\u00e9tudes secondaires ainsi que ceux qui poss\u00e9daient un dipl\u00f4me d\u2019\u00e9tudes sup\u00e9rieures. Il y a lieu de croire que l\u2019Office a utilis\u00e9 le niveau de scolarit\u00e9 comme crit\u00e8re de pr\u00e9s\u00e9lection. Il s\u2019en est servi pour \u00e9liminer les candidats sous-qualifi\u00e9s et les candidats surqualifi\u00e9s. Or, \u00e0 l\u2019insu de M. Sangha, l\u2019Office l\u2019a interview\u00e9 parce qu\u2019il estimait qu\u2019il pourrait pourvoir le poste de conseiller technique, poste de niveau sup\u00e9rieur \u00e9galement vacant \u00e0 l\u2019\u00e9poque.<\/p>\n<p>Le comit\u00e9 a \u00e9vit\u00e9 les questions sur les caract\u00e9ristiques personnelles comme la race, la couleur, l\u2019origine nationale ou ethnique, la religion ou l\u2019\u00e2ge. L\u2019entrevue structur\u00e9e du comit\u00e9 comportait des questions standard portant sur les comp\u00e9tences du candidat, sur ses connaissances de l\u2019Office, son exp\u00e9rience, sa disponibilit\u00e9 et ses attentes salariales. M.
